SA State Of Disaster Will End Soon

South Africa is close to completing the 3 month period that the state of disaster is valid for. The government must now go back to the drawing board before June 15.

Lockdown regulations might no longer be in effect after June 15, as this is when the state of disaster will end. However, the government can add a new set of regulations if it chooses to extend the state of disaster past June 15.

Section 27 of the Disaster Management Act states:

A national state of disaster that has been declared in terms of subsection (1)

(a) lapses three months after it has been declared.

(b) may be terminated by the Minister by notice in the Gazette before it lapses.

(c) may be extended by the Minister by notice in the Gazette for one month at a time before it lapses.

The government can either extend the state of disaster for one month at a time or declare a brand new state of disaster with new regulations. These regulations would have to be in line with the fight to curb the spread of the coronavirus.

Recently, the High Court declared the level 3 and level 4 lockdown regulations unconstitutional and invalid. Minister Dlamini-Zuma was then given 14 days to consult with other ministers in order to change the regulations. 

It is unknown whether the Minister will use this as an opportunity to add new regulations with a new state of disaster or extend the current state of disaster.
